Welcome to GymTechnicians.store. These Terms and Conditions (“Terms”) outline the rules and regulations for the use of the Max Power Repairs Inc. website located at gymtechnicians.store. By accessing or using this website, you agree to be bound by these Terms. If you do not agree, do not use the Website.

1. Definitions

  • “You”, “Customer”, and “User” refer to any person accessing this Website and accepting these Terms.
  • “Product” refers to any item, such as exercise machines, gym equipment, parts, and accessories, available for sale on our Website.

2. Use of the Website

  • To make a purchase on our Website, you must be at least 18 years of age or have the permission of a parent or legal guardian, consistent with Florida contract law (Fla. Stat. § 743.07).
  • You are responsible for maintaining the confidentiality of your account and password and for restricting access to your devices. You accept responsibility for all activities that occur under your account.

3. Products and Services

  • We make every effort to display product colors, images, and specifications as accurately as possible. We cannot guarantee that your monitor’s display of any color will be accurate.
  • We reserve the right to limit the quantities of any Products or services offered. All descriptions and prices are subject to change at any time without notice, at our sole discretion.
  • Certain Products are offered as affiliate recommendations linking to third-party retailers (e.g., Amazon.com). Those purchases are governed by the third party’s terms of sale, not these Terms.

4. Pricing, Payment, and Sales Tax

  • Prices for our Products are listed in U.S. Dollars and are subject to change without notice.
  • We accept the following payment methods: credit/debit cards (Visa, MasterCard, American Express, Discover) processed by Stripe and Square Payments, and PayPal.
  • Florida sales tax will be collected on orders shipped to Florida addresses at the applicable state and local rate, in accordance with Chapter 212, Florida Statutes.
  • By providing payment information, you represent and warrant that the information is accurate, that you are authorized to use the payment method provided, and that you authorize us to charge your payment method for the total amount of your order, including taxes and shipping.

5. Shipping Policy

  • Shipping costs and estimated delivery times are calculated and displayed at checkout.
  • We are not responsible for shipping delays caused by the carrier, weather, or other circumstances beyond our reasonable control.
  • Consistent with Florida’s Uniform Commercial Code (Fla. Stat. § 672.509), risk of loss and title for items purchased pass to you upon our delivery to the carrier. We recommend inspecting all shipments upon delivery and noting any visible damage on the carrier’s bill of lading.

6. Return and Refund Policy

  • We accept product returns within seven (7) days of the order’s delivery date, consistent with Florida’s retail practices under Fla. Stat. § 501.142 (which requires clear disclosure of a store’s refund policy).
  • To be eligible for a return, the item must be unused, in the same condition you received it, and in its original packaging.
  • To initiate a return, contact us at support@gymtechnician.com to request a Return Merchandise Authorization (RMA).
  • The customer is responsible for return shipping costs unless the item arrived damaged, defective, or incorrect. For heavy freight items, return freight will be coordinated by us at the customer’s expense.
  • A restocking fee of up to 15% may apply to non-defective returns of large or freight items to cover inspection and repackaging.
  • Once we receive and inspect your return, we will notify you by email of the approval or rejection of your refund. Approved refunds are processed to your original payment method within 10 business days of approval.

7. Product Warranties

Manufacturer warranties, where offered, are provided directly by the manufacturer and are subject to their terms. Except as expressly provided in a written warranty, Products are sold “as is” to the fullest extent permitted by Florida law. This Section does not exclude or limit any implied warranty that cannot be excluded under applicable law.

8. Intellectual Property

  • All content on this Website — including text, graphics, logos, images, videos, and software — is the property of Max Power Repairs Inc. or its content suppliers and is protected by U.S. and international copyright and trademark laws.
  • You may not copy, reproduce, distribute, republish, or create derivative works from any content on the Website without our express written permission.

You agree not to use the Website or its content:

  • For any unlawful purpose or to solicit others to perform unlawful acts;
  • To violate any international, federal, state, or local regulations, rules, or laws, including Florida law;

To the maximum extent permitted by Florida law, in no event shall Max Power Repairs Inc., its directors, officers, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Website, the Products, or the services procured through the Website. Our total aggregate liability for any claim arising out of these Terms or your use of the Website shall not exceed the amount you paid to us for the Product giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Max Power Repairs Inc. and its affiliates from any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of your breach of these Terms or your violation of any law or third-party right.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or in relation to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Broward County and Miami-Dade County, Florida. Before taking any legal action, you agree to contact us at support@gymtechnician.com to seek an amicable resolution in good faith for at least 30 days.

13. Severability

If any provision of these Terms is found to be unenforceable under Florida law, the remaining provisions will continue in full force and effect.

14. Changes to Terms and Conditions
